Apex Hockey Usage Agreement
Before enrolling in an Apex Hockey program, please thoroughly review this legal agreement ("Agreement") governing your use of the "Program." This Agreement constitutes a binding contract between you and Apex Skating Inc. or Apex Skating USA Inc. By subscribing to our programs, you agree to these terms without any alterations. Apex Hockey reserves the right to deny access to the Program for any non-compliance with the terms outlined herein.
Terms of Product Use
Age Requirements: The availability of the Program varies by jurisdiction and age. If you are under the age of majority in your jurisdiction, you must consult with a parent or legal guardian before enrolling. Those under the age of 13 must not provide personal information without parental consent.
Program Content: You use the Program at your own risk; Apex Hockey assumes no liability for your use of the Program. The information provided through the Program does not create any warranties. By using the Program, you release Apex Hockey from any responsibility for accidents, damages, or losses that may occur.
Territory: The Program is available only in specific countries. You must not use the Program in restricted territories. Apex Hockey may use technology to verify your compliance with these territorial restrictions.
Privacy: Please refer to Apex Hockey's Privacy Policy, which is incorporated into this Agreement, for detailed information on how we handle your data.
Your Information: You must provide accurate registration data and keep it updated. Apex Hockey may terminate your access to the Program if the information you provide is false or incomplete. Your data, including payment information, may be used for account maintenance and billing purposes.
Consent to Use of Registration Data: By enrolling in the Program, you consent to allow Apex Hockey to collect and use your registration data for updates, support, and information delivery. Your data may also be used in an anonymous form to help enhance our products or services.
User Account: You are responsible for maintaining the confidentiality of your account and must not share it with others. You must notify Apex Hockey immediately if you become aware of any unauthorized use of your account. Apex Hockey is not responsible for any losses incurred due to unauthorized use of your account that is not a result of Apex Hockey’s negligence.
Payment Method: We accept credit cards for payment, and billing occurs at the time of purchase. If your transaction is declined, you may resubmit it with the correct information.
Agreement to Pay for Product: By registering for our programs, you agree to pay for the programs you purchase. Fees will be billed at the time of registration.
Refund Policy: Apex Hockey’s refund and cancellation policy is designed to ensure fairness, transparency, and protection of our programs. Families have the option to purchase Camp Insurance at registration through our LeagueApps system, which is the only way to guarantee protection against unforeseen circumstances such as player injury or illness, parent job loss, or family emergencies. Claims for insurance must be made directly through the provider and may require documentation such as a doctor’s note. Without insurance, refunds are not available. Camp registrations are non-refundable under all circumstances, including but not limited to injury, illness, scheduling conflicts, or family emergencies; however, if a player cannot participate due to injury or illness and provides a valid doctor’s note, Apex Hockey may issue a credit toward a future camp, but no cash refunds will be granted. If cancellation occurs more than 30 days prior to the start date, families may be eligible for a partial or full credit at Apex Hockey’s discretion, but cancellations made within 30 days are not eligible for credits except in the case of the medical exception described above. Registrations that misrepresent a child’s skill level may be forfeited without refund or credit, as this undermines the quality and safety of the program. If Apex Hockey cancels a program (e.g., due to low registration, facility closure, or unforeseen circumstances), families will be offered either a full refund or a credit toward a future Apex program. Apex Hockey is not responsible for refunds or credits due to user-controlled circumstances, which include but are not limited to: personal scheduling conflicts such as family vacations or other sports commitments; non-medical illness or injury that does not warrant a doctor’s note or is not communicated in advance; transportation issues such as car trouble or lack of a ride; participant disinterest or lack of engagement after the camp has started; weather-related absences when camp sessions proceed as planned; unexpected financial difficulties affecting payment or attendance; behavioral issues resulting in a participant’s removal or voluntary withdrawal; or general dissatisfaction expressed after the camp has concluded if no concerns were raised during the program. Refunds, credits, or complaints will not be considered once a camp has concluded, and any concerns must be raised directly with Apex Hockey staff during the program. For week-long camps on a payment plan, a 50% non-refundable deposit is due at registration, with the remaining 50% automatically charged 30 days before camp, and enrolling means you are committing to the full tuition; if your child is injured more than 30 days before camp (before the final 50% is charged) and you did not purchase insurance, there are no cash refunds, but with a doctor/physio note your 50% deposit can be converted into a credit for the same player, valid for 12 months from the original camp start date; if injury occurs within 30 days of camp, there are no cash refunds, but with medical documentation up to 50% of the total tuition may be issued as a credit for a future camp for the same player, also valid for 12 months; for schedule changes or any non-injury reasons, cancellations more than 30 days out result in the 50% deposit being forfeited with no refund or credit, and within 30 days of camp the full tuition is non-refundable and not eligible for credit; if the card on file is declined for the remaining 50% and not resolved within 48 hours, your registration may be canceled, your spot offered to another player, and your 50% deposit retained as a cancellation fee; when issued, credits are non-transferable, must be used for the same player, and are subject to camp availability; because refunds without insurance are very limited and generally only available as partial credits for documented injuries, we strongly recommend optional camp insurance, which may provide broader coverage and more generous refunds or credits in the event of injury, illness, or other covered situations, subject to the insurer’s terms.
Skill Level Grouping: Apex Hockey reserves the right to group participants according to their skill level and capability as determined by our staff’s discretion. This ensures that all participants receive the appropriate level of instruction and can benefit fully from the program.
Right to Remove Participant: Apex Hockey reserves the right to remove a player from a program if their skill level is deemed to be not at an adequate level. This decision is made to ensure the safety and appropriate development of all participants.
Coach-to-Player Ratios: Apex Hockey does not advertise specific coach-to-camper ratios for its programs. While we strive to maintain effective ratios to ensure quality instruction, actual ratios may vary based on factors such as enrollment numbers, staffing, and specific camp activities, and are subject to change.
Makeup Policy: In unforeseen circumstances, please contact Apex Hockey regarding makeup sessions or credits. While we strive to accommodate such requests, makeup sessions or credits are not guaranteed.
Applicable Taxes: Taxes are based on the billing address provided at the time of transaction and the applicable tax rate at the time of completion. Any changes before product viewing may be subject to adjustments.
Right to Change Prices and Availability: Program prices and availability may change at any time without prior notice.
Electronic Signatures and Contracts: Electronic submissions signify your agreement to this contract.
Termination: Non-compliance with any terms of this Agreement may lead to termination of your access to the Program without notice. You will remain liable for any amounts due until the termination date. Apex Hockey reserves the right to refuse access to the Program.
Enforcement of Terms: Apex Hockey may take steps to enforce and verify compliance with these terms, including cooperating with legal processes as necessary.
No Responsibility for Third-Party Materials: Apex Hockey is not responsible for third-party materials or websites linked to the Program.
Disclaimer of Warranties; Liability Limitations: Apex Hockey does not guarantee uninterrupted use of the Program. You use the Program at your own risk. Apex Hockey’s liability is limited as outlined in this Agreement.
Waivers and Indemnity: You agree to indemnify and hold Apex Hockey harmless against any claims arising from your breach of this Agreement or actions taken during investigations into such breaches.
Notices: Notices from Apex Hockey to you will become effective immediately.
Governing Law: This Agreement is governed by the laws of Ontario, Canada, and Delaware, USA. Jurisdiction for any claims or disputes resides in the courts of these locations.
Miscellaneous: This Agreement constitutes the entire understanding between you and Apex Hockey. Apex Hockey is not responsible for failures beyond its control.

Other Websites: This Privacy Policy applies to the Site; it does not cover links to other websites.
Responsibility: Apex Hockey is not responsible for the use of information by third parties disclosed under this Privacy Policy.
Safeguarding Personal Information: We take reasonable precautions to secure personal information.

Additional Liability Waiver: It is the purpose of this agreement to exempt, waive and relieve releasees from liability for personal injury, property damage, and wrongful death, including if caused by negligence, including the negligence, if any, of releasees. "Releasees" include Apex Skating Inc., Apex Skating USA Inc., its event hosts, other participants, coaches, officials, sponsors, advertisers, and each of them, their officers, directors, agents and employees. For and in consideration of the undersigned participants registration with Apex Skating Inc. or Apex Skating USA Inc., participant (and the parent(s) or legal guardian(s) of participant, if applicable) waive, release and relinquish any and all claims for liability and cause(s) of action, including for personal injury, property damage or wrongful death occurring to participant, arising out of participation in Apex Skating Inc's or Apex Skating USA Inc's events, the sport of ice hockey, and/or activities incidental thereto, whenever or however they occur and for such period said activities may continue, and by this agreement any such claims, rights, and causes of action that participant (and participants parent(s) or legal guardian(s), if applicable) may have are hereby waived, released and relinquished, and participant (and parent(s)/guardian(s), if applicable) does(do) so on behalf of my/our and participants heirs, executors, administrators and assigns. Participant (and participants parent(s)/guardian(s), if applicable) acknowledge, understand and assume all risks relating to ice hockey and any physical activities, and understand that ice hockey and physical activities involve risks to participants person including bodily injury, partial or total disability, paralysis and death, and damages which may arise therefrom and that I/we have full knowledge of said risks. These risks and dangers may be caused by the negligence of the participant or the negligence of others, including the releases identified below. These risks and dangers include, but are not limited to, those arising from participating with bigger, faster and stronger participants, and these risks and dangers will increase if participant participates in ice hockey and physical activities in an age group above that which participant would normally participate in. I/We further acknowledge that there may be risks and dangers not known to us or not reasonably foreseeable at this time. Participant (and participants parent(s)/guardian(s), if applicable) acknowledge, understand and agree that all of the risks and dangers described throughout this agreement, including those caused by the negligence of participant and/or others, are included within the waiver, release and relinquishment described in the preceding paragraph. Participant (and participants parent(s)/guardian(s), if applicable) acknowledge, understand and assume the risks, if any, arising from the conditions and use of ice hockey rinks and related premises and acknowledge and understand that included within the scope of this waiver and release is any cause of action (including any cause of action based on negligence) arising from the performance, or failure to perform, maintenance, inspection, supervision or control of said areas and for the failure to warn of dangerous conditions existing at said rinks, for negligent selection of certain releasees, or negligent supervision or instruction by releasees. If the law in any controlling jurisdiction renders any part of this agreement unenforceable, the remainder of this agreement shall nevertheless remain enforceable to the full extent, if any, allowed by controlling law. Participant (and participants parent(s)/guardian(s), if applicable) agree if any claim for participants personal injury or wrongful death is commenced against releasees, he/she shall defend, indemnify and save harmless releasees from any and all claims or causes of action by whomever or wherever made or presented for participants personal injuries, property damage or wrongful death. Participant (and participants parent(s)/guardian(s), if applicable) acknowledge that they have been provided and have read the above paragraphs and have not relied upon any representations of releasees, that they are fully advised of the potential dangers of ice hockey and understand these waivers and releases are necessary to allow amateur ice hockey to exist in its present form.
